The Local Government Finance Act 1992 and the Reduction for Disabilities Regulations 1992, provide for a reduction to the valuation band immediately below that allocated to the dwelling, as shown in the Banding List, providing that certain qualifying conditions are applicable. They are:-
- a disabled person must be resident in the dwelling
and
- the dwelling contains a room other than bathroom, kitchen, or lavatory which is required for meeting the needs of a person with a disability, Usually, this means that the room must have been adapted for a purpose other than for what was originally intended. An example would be where a bedroom has been specially altered to accommodate dialysis equipment for use by the disabled person,
or
- an additional kitchen or bathroom which is required for meeting the needs of a person with a disability, -though a separate ‘toilet’ only does not qualify for this reduction
or
- there is sufficient floor space to permit the use of a wheelchair required for meeting the needs of a person with a disability resident in the dwelling.
A wheelchair is not required for meeting a person's needs if he or she does not need to use it within the dwelling.
Properties in Band A can also qualify for a reduction, if the conditions are satisfied. The Council Tax will be reduced from 6/9ths to 5/9ths of the Band D amount.
